Legal Question in Bankruptcy in Nevada
filing a motion of stay
what happenes if a motion of stay is filed and granted because the bank insisted there was no equaity in the home the motion is granted and the bank sells the house at $100,000 profit.does the bank have to give the profits to the bankruptcy courts to divide among the other creditors or do they just keep the profits for themselves? THE OTHER CREDITOR IS A SERCURED CREDITOR AND SINCE THERE WAS A PROFIT ARE THEY INTITLED TO THIER MONEY.the other creditor is a trust deed holder on that house.
