Legal Question in Bankruptcy in Nevada

Home sale after bankruptcy

I hope to avoid bankruptcy but, should it happen, how may months or years after bankruptcy is filed and discharged may I sell my home. At the moment it is under the homestead law in Nevada. I do not want to sell, but have ailing parents in another state and may be forced to sell to be with them.

How long must I wait to sell my home after filing Bankruptcy?

You can usually get written permission from your Trustee to sell your house at any time during the Bankruptcy. Yes, you still can keep ALL your equity (as long as it is within the $200,000 limit of homestead). You will want your attorney to draw up the paperwork so that escrow closes smoothly.
