Legal Question in Bankruptcy in Nevada
Possible Incompetent Representation?
We retained an attorney to file Chapter 13 and have had numerous issues. We supplied all the documentation and went to our 341 meeting. After being sworn in we found that the attorney had failed to supply any documentation to the court so the meeting was rescheduled. We arrived a week later and the attorney failed to show up to the 341 meeting at all until we called the office and demanded they send someone to represent us. Then we received the Plan Summary from the Bankruptcy Court demanding we pay $1500 a month more than the atty. ever stated. Turns out they messed up the means test. We tried to contact them for over 3 weeks to get a plan modification done yet they never returned our calls. Finally showed up and they took the correct information. Now we are 2 months away from the payment increasing and we're trying to find out if they submitted the plan modification. We have left almost a dozen messages at the firm over the last 2 weeks asking for a yes or no answer to this question and they have not returned a single call. We are at our wits end. I'm considering filing a complaint with the State Bar for violations of their code of ethics due to all of the issues and lack of communication. What are our options?

What you need to do first is get your bankruptcy back on track. I will charge you $300 to pull up on your schedules, statements and plan to review and give you advice. It appears that you have had your plan confirmed?
