Time Period Between Filings & Number Of Filings

My husband has had two prior discharged Chapter 7 bankruptcies, one when he was in his early twenties and the last one in October 1997 right before his divorce.

What is the time period required before you can file again? And is there a limit to how many times you can file for Chapter 7?

Also, would we need to submit copies of our federal taxes?

I ask this because I had filed individually (as single, not living together). I have been employed for the last year and a half, he has not. And he hasn't filed taxes for the past 2 years.

Any opinions would be greatly appreciated!

Time Period Between Filing & Number Of Filings

The waiting period between filing Chapter 7 cases is 6 years. There is no limit to the number of times a person may file. The Chapter Trustees usually ask for a copy of a tax return for the current year & the upcoming year. They have the right to ask for additional information, such as paystubs, statements & receipts for living expenses, etc. If a person is married, their spouse's income information will be an issue in the case. So I wouldn't assume that if your spouse files, it is just "his problem."
