Legal Question in Bankruptcy in Nevada
I have been unemployed for approx one year (heavy equipment operator). I owe 70,000 in child support to the State of Calif. About half of this 70.000 is interest. I cannot make the set payments, let alone the interest. Payment was set at 364.00 per month. On top of that is 309.00 interest for arrears. I live in Nevada and my daughter, who is age thirteen, lives with her mother in Calif. What can i do. Can I file chapter 13 in this case?

A Chapter 13 Bankruptcy can be a good way to take care of past due child support issues for a number of reasons. First, it prevents you from facing the threat of jail if you aren't able to make the payments; second, the payments are determined by what you can afford, not by what you owe; third, you can request that interest be reduced or eliminated. But you need to show that you are eligible for a Chapter 13 in order to get the many benefits of this program.
I would recommend an in person consultation with myself or someone that handles Chapter 13 cases on a regular basis to help you make this decision. Good luck!
