Legal Question in Bankruptcy in Nevada
I�m walking away from my home and would like to file Ch 13BK I was told that I would have to wait 90 days to file because I used my credit card? What would happen if the back forecloses before I file?

Actually, if you file Chapter 13, you usually do not have to wait to file because you used the credit cards. However, a Chapter 13 might not be appropriate for you if you intend to walk away from the home. If your mortgage company holds the foreclosure sale before you file your case, the property cannot be recovered in a Chapter 13.
I would really suggest that you meet with someone who is qualified to help you plan your bankruptcy. You have some issues that I don't think have been explained properly & could cost you a lot more in legal fees & aggravation than is necessary.
