Asset Purchase including Non Compete
I am purchasing the assets of a small business from a C corp. The prior owner purchased this business two years ago and died shortly thereafter. Included is a non-compete agreement from the prior owners (the owners before the person that died). These former owners are still in the area and will receive a large payout from the estate - thereby giving them the captial to open a competing business. The non-compete is with the ''Buyer'' listed in the previous agreeement (the deceased), there is no mention of assigment or succesors in the non-compete. Is this non-compete enforceable?

No. It would have to be agreed to.
