Legal Question in Business Law in Nevada
What legal action (if any) should I take?
I purchased custom furniture from a Las Vegas business. The total purchase was $6K and I paid a $3K deposit. The invoice states that the furniture would be delivered in 5-8 months. It's now been almost 17 months and I still haven't received the product. I'm worried about losing my $3K deposit, so I already asked for a refund. Unfortuately, they haven't responded to numerous VM's and e-mails. If they don't provide my refund by 05/30/09, then I'm thinking I may need to call on legal advice.

Send a letter, certified mail, return receipt, to them, this week, demanding a refund of your deposit.
Keep a copy of the letter.

One approach might involve a small claims action for unjust enrichment, restitution, fraud and violation of Nevada consumer protection laws, including interest at the legal rate from the promised delivery date, plus costs of suit, against all parties in any manner involved in the transaction, jointly and severally. Check local court dockets for other aggrieved individuals, as potential witnesses to a common plan or scheme by the defendants.
Another approach might involve making a detailed written consumer complaint to the local District Attorney or State officials having jurisdiction. They may want to help you and thereby justify their jobs in these economic times.
These are not mutually exclusive approaches; your attorney can explain further.
