Legal Question in Business Law in Nevada

Are online rental agreements valid?

I have a online reservation service for vacation rentals in Mexico. I currently send my clients a rental agreement which they sign and fax or mail back to me. An online form I suppose something like a software user agreement or the like would be much easier and faster. Is this possible, legal, advisable, etc?

Re: Are online rental agreements valid?

An online rental agreement could potentially work, although the main issue would be whether the client was reasonably informed of the content within the agreement. If they must clearly mark that they have read and acknowledged the agreement, then you are in a much better position to justify your claim if an individual breaches the agreement. A hard copy of an agreement that must be signed would be preferable, but an agreement that must be affirmatively marked as being read by the customer could be effective as well.

There are may "issues" that come up in online agreements. Many things to consider, for example, enforceability, payment guarantee, what laws apply, etc.
