Legal Question in Business Law in Nevada
down payment on a new car
I wrote a check for a down-payment on a new car. The check was cashed but the car hasn't arrived. Can they cash my check, and can I back out of the deal.

Re: down payment on a new car
Whether you can cancel the purchase at this late date probably depends on the wording in the contract regarding delivery of the purchased vehicle. It may well be that if they have not been able to perform (deliver the car), you can still back out without penalty. If, however, it was a special order, and the dealership committed resources to the order, the purchase agreement may have you pretty tied down.
If you are in northern Nevada and would like to have the contract reviewed to see if you can legally escape, please call my office at 775-358-1958. I would be happy to provide a free initial consultation.
