Legal Question in Civil Rights Law in Nevada

In my apt complex their was a shooting.my apartment bldg was hit along with another bldg.the bullet holes are a large size. my children have suffered because the managemment hasnt fixed the damage that was caused from that night. it has been well over 4 months. my neighbor and her daughter is attending counsling from the trama. their are so many code and building violations that are not being adressed. when my children take a bath the water goes through my floor. when i let management know, they sent some one out to look and they fixed nothing. the park where my children play is dangerous and hazardous. i would like to know if i can sue the company who owns them and would it be better if all the people that have a problem with the way my apts are being ran sue as well? would that be a class action? how should i go about this situation?

I don't see a class action here. What I see, if the facts are as you say, and that can be a big 'IF', is that the building complex management has breached its duty to supply you with a habitable place to live. Meaning, all the plumbing and electrical work, the roof doesn't leak, the common areas get cleaned up, any unsafe conditions in the common areas, or any in your apartment that you didn't cause get cleaned up.

You're remedy is mostly to just move out after telling the landlord in a comprehensive list, with pictures that the conditions you describe exist and that they have failed to fix them and if they don't fix them within 30 days, or whatever time you like, you will move out. Or, you can pay to have these conditions fixed yourself and deduct it from your rent.

You might be evicted, or they may attempt to evict you after you notice them of either of these things. If you have a lease, they may attempt to collect on the balance of it from you. Remember, what the landlords, governments and courts have been saying now for years is essentially - who ever has the most cash wins. So, be careful.
