Entrapment

My wife is employed as a supermarket checker. On one occasion a customer was in the process of purchasing a six pack of beer.

Before this transaction, my wife asked the customer if she was over 21. This question was witnessed by another customer to which she has given us a signed affadavit affirming this.

The beer buying customer responded with an affirmative nod of her head. My wife then asked for the customers' I.D. which she in turn misread it and returned to the customer.

Upon the completion of the sale, my wife was informed that she had just sold beer to a minor and was cited for said violation.

I believe that this particular sting operation should have been termited at the point when my wife asked the customer if she was 21. Am I right or wrong, and if right, what are her remedies?

It sounds reasonable, but then I only know what you have told me. Is she charged with a crime?

Which one? If so, post this under criminal law.

If it has something to do with employment or a dram shop act case, you are in the right place.

Why was the store the target of a sting? Did a lot of kids buy beer there?
