Car Loan Secondary

My duaghter is the secondary on a car loan, she is no longer with the guy who is the primary. He has failed to pay the loan and she has been contacted by the loan company. Can she take him to a small claims court to have her name removed/car sold etc? Or can we just go and get the car and sell it?

She can't have her name removed without paying it. You can sue him and then repossess the car but unless she is on title, she cannot just go and get the car.
