Car Repo
My brother had recently signed with his ex girlfriend to buy a new truck. He is the primary, but she drives the car and is suppose to be paying on it. She fell behind three months ago and he made one payment to catch it up. So two more are owed and he does not want to pay for a car that he is not driving. She refuses to give the truck over to him and she will not make the last two payments before it goes to repo. He wants to save his credit and will pay the payments from here on out and catch the current payments up. How can he get the car from her, and what are his rights? She said she will call the cops if he trys to get it. But he is the only one really paying for it currently. If he cant get the car legally from her. does he have the option to sell his half of the car and make her buy him out or be forced to sell it? Thanks Tom

I would repossese the car and have it sold at auction. He must carefully follow the law or he will be civilly liable for conversion.
