Legal Question in Credit and Debt Law in Nevada

Child support was filed in the state of Nevada and a lien for past support was filed with the courts, through Washington state and Nevada child support thus his workers compensation was garnished. A large settlement was paid out and the workers compensation admittedly forgot to hold the rest of the support. Are they liable for the money, and is this negligence?

If the government agency has a clear, non-discretionary duty to pay over funds it is administering in a workers compensation claims settlement, and evidence proves such duty was breached resulting in loss or damage to the child support payee, the payee may be able to bring a proceeding against the government agency for negligence.
