civil summons

I just found out by mail that a creditor has been trying to serve me with a summons. They have been unable and are now requesting from the court a service by publication with an extension of 120 days with which to serve me. If they are doing this by publication for 4 weeks why would they ask for a 120 day extension? Don't they have to ''personally'' serve me?

No. If they try and show the judge that they just can't do it, they will serve you by publication. The reason that they are asking for the 120 days is that there is a deadline.

They will get a judgment against you by publication so you might as well accept service and go from there. The only issue is if you have a statute of limitation defense, over six years, you may not want to accept service in the hopes that they don't serve you in time, and the case gets dismissed.
