Each credit card transaction slip may constitute a "contract", including a direct promise to pay, by the person signing the paper. Each credit card issuance agreement may likewise have similar provisions. The entire credit card system is governed to some extent by State and Federal laws too numerous to be outlined here. Those laws might bear on whether a credit card lawsuit upon an alleged default would be approved by a court. Unless the account and transactions made under its terms are reviewed, there is no definite answer to your important and interesting legal question.
Your attorney can explain further.
