Legal Question in Credit and Debt Law in Nevada
What happens when I fail to pay my credit card monthly payment for 6 months in a row? Does the credit card company have to forgive the debt I owe?
1 Answer from Attorneys
What happens is a business decision that the credit card company makes. There is no hard & fast rule. Some will turn you over to collection, others will refer you to their attorney to file suit. The credit card company does not have to forgive the debt at all, they are in business to make money, not to give it away. If they send you to collection, you can count on your credit being ruined. If they sue you, they can garnish 25% of your wages every pay day until the debt, plus interest, plus attorney fees, and plus court costs, is paid off. They can also seize your bank account and file a lien on any real estate you own.
As a Bankruptcy attorney, I represent people who think that nothing will happen if they don't have to pay their credit cards. Usually they have to suffer in order to find out that there are consequences to not paying your credit cards.
Bankruptcy is not appropriate unless your debt situation is overwhelming & there is no other choice.
