My husband had surgery in 2001. Prior to the surgery it was authorized by the insurance comapny twice. The doctors office was told what the benefit was and we were charged for our portion in advance which was paid prior to the surgery. My insurance company had trouble with the idea of paying two surgeons and did not pay for the second one until February 2007. During that time I contacted the doctors office quite regularly at first and finally stopped calling in 2005 after I was told repeatedly not to worry about it that it was being taken care of. Since the payment in Feb. 2007, I received a bill for just over $1000. Knowing that this was an 80/20 plan I was charged in advance and paid what I was lead to believe was my portion in full. Can I be charged 5 1/2 years later and am I liable for this amount? Thank you.

Yes and no. They probably have an agreement with the insurance company to accept their payments as payments in full. If not, you could be liable and sue your insurance company for bad faith for not paying a bill in full. Finally, since there was a payment, they have until Feb. 2013 to sue you (six year statute of limitation on written contracts)
