Payment Arrangement with Ex-Boyfriend

My ex boyfriend and I had a verbal agreement to use his credit card for some of our expenses (eating out, household supplies, etc). When we broke up, my half was approximatly $900. I am a full time student and have a very small income every month ($400). As long as I pay him a resonable amount ($100) every month, can he sue me for the full amount?

Re: Payment Arrangement with Ex-Boyfriend

He could sue you but may not prevail. Payment arrangements do not prevent the filing of a lawsuit unless there is an agreement to that effect, and even then that could be hard to prove. In any event, he should not be allowed to prevail in any lawsuit for an amount greater than any obligation you undertook--which was one-half of the full amount due. You don't make enough to garnish and therefore, in addition to the above reasons, I believe it would be unwise for your ex-boyfriend to sue you on a debt on his card.
