St. Rose Assigns Paid Account To Collections

St. Rose Hospital has kept money paid on a hospital bill and refused to credit the patients account. They have assigned the account to collections and refused to even acknowledge they were overpaid until confronted by Blue Cross with copies of the cancelled checks.

Blue Cross said St. Rose wants to perform an internal audit to find out where the money went, yet, the account remains in collections and has been reported to the credit agencies.

We have collection agencies from 3 states calling. Blue Cross said they can't force the hospital to credit the money to our account nor can they take the money back.

An attorney here said to get an attorney to straighten things out. Dave Ramsey's nationwide audience said the same thing.

I was told that we are entitled to punitive damages and even the Nevada Dept of Financial Institutions said to get an attorney.

How do we do this for Nevada, I am the insured and I live in California, the patient, my dependant lives in Nevada for school.

The attorney out here said his fee's would take any money recovered plus additional fee's and pretty much said, to find someone we can afford.

Any suggestions - please no Catholic's they stole the money in the first place.

From your (angry) message, it sounds like they need to at least credit those who paid them, and it shouldn't be in collections. They might be violating the Fair Debt Collection Practices Act by trying to collect money to which they're not entitled, if I am understanding what you are saying.

You should contact an attorney in your area to correspond and communicate with St. Rose to see why they can't straighten this out immediately.
