attempted robbery

My son is being charged with attempted robbery. Though the store clerk statement says he and a few friends came into his store and started getting loud and arguing with him. The clerk said he saw something in my sons pants ''something black''. There was never a demand for money or merchandise but they have a pic of my son on camera walking out the store. (empty handed) They offered to drop some other charges if he signed a waiver. Can this happen? Can they charge him without evidence?

The District Attorney has to put on the evidence they have at a preliminary hearing. I assume the DA is offering a plea deal and asking that you sign a waiver of your pre

liminary hearing as part of the plea.
