Legal Question in Criminal Law in Nevada
To Bail Or Not to bail
If someone is in jail in New York and has a hold in Nevada
does that person need to be bailed out before extradition proceedings can be started? Or can he start extradition while he is still being held in New York Jail? $5,000 is riding on this question. Thanks

If the criminal will be prosecuted in Ny and face a lengthy jail term in NY, then there is no need to post a bind in NV.

If Nevada has filed a detainer in New York, the Deptarment of Corrections will not release the person even if you pay the bail on the New York case. A detainer prevents release.
