Legal Question in Criminal Law in Nevada

I was just wondering how I could bring up a claim against one family member who has used my father's atm card without his consent. My father is in the hospital and never to my recollection gave this person any kind of permission to take his card and use it. This family member knows the pin #, but I still want to know if it is fraud or not. Could you please help me understand the rules dealing with this situation? Thank you.

Using the credit card of another is a felony in Nevada. However, the police will only accept charges from the card holder or the credit card company. Also, the D.A. is reluctant to file in family member situations.
