Legal Question in Criminal Law in Nevada
Judicial sentencing gudelines
Is it legal for a judge to accept a plea bargain and impose sentence on a defendent, then state the defendent smiled after imposition of sentencing so she is withdrawing the sentence and setting it for trial. The smile was one of relief as we have been trying to settle this for over 2-years.

Re: Judicial sentencing gudelines
This is why you have to behave in court. Until the sentence is imposed on the record the judge has discretion to change his or her mind. Of course you can file a motion for a reconsideration or an appeal.
