marijuana arrests

my boyfriend and his brother were

arrested with possession of pot (2

pounds each), intent to distribute

and sale, felonies. His brother also

had about 300 grams of hash. This is

their first offense ever and I was

wondering what they are facing.

If it's state court 1-4. If its federal court 5. Probation is possible w/a good attorney.

Many felony charges come with a sentencing range of 16-2-3 (16 months, 2 years, 3 years). This means for each charge, the potential punishment can be anywhere within this range.

The next question would be whether they will be sentenced concurrently or consecutively. This means that if found guilty of all three charges, will the court run their sentences concurrent (running at the same time), or consecutively (running back-to-back to one another). Consecutive sentences could mean they could face three 16-2-3 sentences.

However, this information is purely speculative and I cannot say how likely any of these scenarios may be.

The outcome depends on the facts of the case, the history of the defendants, etc.
