Possession With Intent To Distribute

What are the guidelines for charging a person with intent to distribute?

This person had the controlled substance (methamphetimine) in a plastic bag together with his drug paraphanelia (glass pipe) which was for personal use only. I could understand the charge if he had more than one bag on him.

What are the mandatory sentences in Nevada for first time drug offenses? And what if he has a prior record for different charges and completed his probation/sentence? Would this be taken into consideration at sentencing?

Any opinions???????

This is a probationable offense which is usually reduced to possession. A prior non-drug offense will likely not enhance the sentence which is 1-5. Simple felony possession is mandatory probation.
