Returning Stolen Property
There was this girl who let a friend of mine look through her phone to see if his girlfriend was talking to other guys on her phone. He ended up dropping it into some water and setting it aside to dry. When she came back later for the phone, they couldn't find it. A few days later the cops came for it. He found the phone and gave it to the cops, who gave it back to the girl. He was arrested for Grand Larcency. He didn't steal the phone. Plus she has it and uses it. She also dropped the charges and the DA picked it up. Why is he still in jail? He returned the phone. He didn't steal it, she let him use it! The cheating girlfriend knew where the phone was and wouldn't give it up. Why wasn't she arrested instead?

The District Attorney makes the determination based on the evidence they have whether or not to pursue a matter. It does not always make sense. The bottom line is your friend probably needs to hire an attorney.
