Legal Question in Criminal Law in Nevada

Simple Assault

I am a new tenant and have been harassed by the person living below me since I moved in. She says I make ''too much noise.'' On 1/11/2009, she left a nast note on my door after knocking loudly, then disappearing. I went to her apartment to try to talk to her. When she opened her door, she said, ''Oh, it's you, you c--t!'' and started to slam the door. I put my cane in the door so she couldn't close it, but she called the police and said I attacked her with my cane and hit her as soon as she opened the door. She also stated I was trying to push my way in to her apartment. She has filed many police reports with different people in this complex, had many fights and is almost always the agressor. I requested a public defender to assist me with my defense, but was denied because this crime does not include jail time if convicted. Don't I still have the right to a public defender to assist in my defense and issue subpoenas, etc? Can I petition the court to reconsider?

Unless the prosecution is going for jail time the Judge does not appoint public defenders. You can ask the Judge to reconsider but I doubt if the Judge will. Perhaps you should consider hiring a paralegal if you cannot afford an attorney.
