Legal Question in Family Law in Nevada
Annulment of bigamous marriage
I live in Calif. and earlier this year was married to a man in the state of Nevada. I have since found out that his divorce from his first wife was not final. I need to file for annulment, the grounds, of course, bigamy. I need to know the easiest, least expensive way to do this. Can I do it myself? Does it get filed in Nevada, or where I live? We have never lived together as husband & wife, either - as he had taken a job out of state, and I found out before I moved there (thank goodness.) Also, is there some time limit for filing, and if so, does it start from date of the marriage, or when I found out about the bigamy?

Re: Annulment of bigamous marriage
Good afternoon, Madam:
The Nevada Legislature has developed a great basic research site covering
all of the statutes and administrative regulations, including references to
Nevada Supreme Court decisions related thereto, available at:
http://www.leg.state.nv.us
You may want to look into the chapters on Dissolution of Marriage on this
site. In this regard, I invite your attention to NRS Chapter 125, which is
found at:
http://www.leg.state.nv.us/NRS/CH_125.html
You may want to look into the chapters on Custody and Visitation on this
site. In this regard, I invite your attention to NRS Chapter 125A, which is
found at:
http://www.leg.state.nv.us/NRS/CH_125A.html
You may want to look into the chapters on Obligation of Support on this
site. In this regard, I invite your attention to NRS Chapter 125B, which is
found at:
http://www.leg.state.nv.us/NRS/CH_125B.html
There may be other laws affecting your ability to resolve a divorce,
support or custody problem, which is necessarily beyond the scope of this
reply.
I charge $200.00 per hour for consultation, document review, case analysis,
advice, suggesting and recommending alternatives, legal drafting, telephone
calls, legal research and prosecuting or defending divorce, annulment, separate
maintenance, support and custody actions when I am hired by a client.
Upon your written request I will send a proposed retainer agreement offering
employment in an uncontested Washoe County, Nevada annulment proceeding only,
which offer will expire Friday, July 23, 1999,
if I am not retained by then. I am only hired when I am paid and the the retainer
agreement is signed and in my possession.
If I do not hear back from you by Friday, July 16, 1999, I will assume that you have
answered your questions to your own satisfaction, hired another lawyer, or decided
against pursuing the matter.
I hope this is of assistance to you.
