auto divorce

about to file for divorce. Bought auto while we were married. My credit was bad, so we put the auto in my spouse's name. Can she go behind my back and sell the vehicle, and if she can, is there anyway I can stop it. I live in a community property state.

First, she needs the car to sell it so that is a non legal way to stop her, don't give her access to the car. Furthermore, once you file, you can get the clerk to issue a joint preliminary injunction, this will penalize her if she sells it.

Make sure that you make the payments so she can't justify selling it.

If you are about to file for divorce, I would urge you to contact my firm and do it right. Many people try to file their own and only come to an attorney when it's difficult to unravel what's been done wrong.

Having said that, title is irrelevant as to community property. You know as well as I do that no piece of paper will stop your wife from trying to sell the car if she wants to. But I would suggest writing the lender and notifying them that you have an interest in the car and should be notified if it is sold since you are going through a divorce.
