Greetings, my brother got married in Las Vegas Nevada on a whim. Found out the girl her married was not divorced from her first marriage! This relationship is now over, was his marriage ever legal? Is the marriage real where a divorce is now required? Thanks for your help.

To avoid confusion an annulment complaint should be filed. I would expect that there would be no opposition to the annulment complaint.

The marriage, by operation of law, is not legal.She should divorce "first" husband.He should then consider "another" marriage after the divorce.An annulment of the so called second marriage followed by a divorce of the first marriage may also be an option. The issues are far more complicated than my response.You will need to address the matter comprehensively with an attorney

My approach would follow Gary Moore's. In real-life situations like your brother's I have pursued an annulment under Nevada law.
