Legal Question in Family Law in Nevada

My brother's daughter may be going to jail in Nov. due to a felony drug charge. She has had other arrests~battery being one)

She has a 5 yr. old daughter. The 5 yr old has special needs and is being neglected by her mother. Missing school-42% attendance rate. Going to school hungry. The school was just about to call child protective services when his daughter got arrested. Up until that point he thought his granddaughter was attending school and being fed~

My brother would like to get custody of the 5 yr.old. The 5 yr old and her mother have lived with my brother since her birth.

My brother works about 10 hrs per day. 5 days a week. (This is why I am emailing you)

How could he get custody of the 5 yr. old? Or could he? Thank you, Linda

I note you do not say anything about the child's natural father -- which could be important to answering your questions, given the preference given to natural parents not found to be unfit. That said, thee are multiple possibilities -- guardianship, temporary custody, ranging to full adoption. Your brother needs a full, in-depth consultation with qualified counsel.
