Cheating Jailbird...does he have ANY rights?
I was married in 1999 in San Bernarsino County, CA. No paperwork was ever filed. Since that time my husband has served 3 prison terms, primarily for drugs and recently I found out he has fathered 2 other children during the course of our marriage with 2 different women.
We do have a daughter together who has Down syndrome. I moved to Nevada during his last incarceration last November with my daughter who is 3.
I have not spoke to him since his release in June. He knows where we are and has seen his daughter, only through arrangements made through his sister.
I filed for child support in Nevada. He resides in Riverside, CA. They claim not to have enough info on him for my case - although I provided EVERYTHING they requested. Address, SS#, workplace...everything. I don't know what is going on but I really need financial assistance from him.
Don't know whether I need to file for divorce. Would like to move to Missouri with daughter after the school year. Does he have any rights as a father if he doesn't have any contact with us? Can this be considered abandonment if I left while he was incarcerated to move in with my family for support and he has made NO effort to contact us or provide any assistance?

You need to file for divorce and/or custody in order to move.
