Legal Question in Family Law in Nevada

I am currently in a child custody battle where I am trying to get permission to live out of state and because I am in between homes right now for the first time ever my kids dad got temporary custody.

Right now though I am just simply tyring to take my kids where I am trying to move on a two week vacation, reason being that place, well that is where my husband has been stuck working and living for almost three years. We have family and friends there and I have planned a two week vacation that I have every right per our court order to plan. but now the dad is telling me that he is not going to

allow me to take our child with me on vacation because I am a flight risk...which is the furthest from the truth. I dont understand his logic, he takes our kid on vacation out of state but is refusing to allow me to do the same, even though in our order it staes NOWHERE that he is able to do so. What do I do when the time comes for me to pick up my child to leave for vacation and it is denied???

You need a lawyer. Your case is very difficult and will probably have an all day evidentiary hearing. I am unsure how your husband can deny you unless he just does not let you pick up the children. Do you have a court order? Police would enforce that. You are allowed to leave the state with your children so long as it is not your intent to move your children there.

If you want to move your children, you need to obtain primary custody and then, get permission to move the children out of state. If you would like to hire me, you may contact me at [email protected]
