If the father of my child refused to sign her birth certificate does that give him any legal rights to her ? He already has two children from a previous marriage that he does not pay support for. I believe the courts could put him in jail if they wanted to for back unpaid support. What happens if i get married, can she also have my married name? Can he legally strike back if he is not listed has her father on any documents.I greatly appreciate any answers you can give. By the way the baby is 4 months old.

Parental Rights
Parental rights can be formally established or taken away by Court order in these situations.
The Family support division of the district attorney can establish these orders for you at no cost. However, if you wante to end his rights to the child, you will need to bring a private suit.
