child custody

my son lives with mom, 11-yrs old. How old before he is allowed to decide who he lives with.

There is no set rule. As the child get older his opinion counts more and more. However, the Judge will look at the totality of the circumstances before changing custody to see if it is in the child's best interest.

Nevada does not have any statutory or judicially established age limits where the child's individual wishes will be the primary factor in determining custody. However, the closer the child gets to reaching 18, the more the Court will weigh their wishes.

The standard used in determining custody is the "best interest of the child." The Court will look at all facts surrounding the child's custodial options and weigh them.
