Child custody/child support

I'm not married to my sons father. How would i obtain primary custody of my son. I am providing medical insurance and the father is working in ca for a small valet company, getting paid under the table. He can not prove his income so how would i get child support. Also the father as a dui would this help with me getting primary custody.

You need to file a case, establish paternity and obtain an order for child support. If the dad responds, he will be asked to fill out a form showing his income. We would then argue that he is paid under the table and the judge would consider it.

As to the DUI, how long ago? Has he resolved his drinking problem?
