Legal Question in Family Law in Nevada

Child does not want to live with mother

Child is 16 and does not want to live with mother, I have been taking care of her for over 2 yrs. She wants to stay in this high school with her friends. Mother has moved her several times a year until 2 yrs ago (the mother has moved 4 times in the last 2 years). Since I am not her biological father and she wants to live with me does she have a right to do so at age 16 or does she need to apply for emancipation. If need be what kind of lawyer do I need to retain.

Re: Child does not want to live with mother

An emancipation is one way to go. On an uncontested basis, it is relatively easy, but if the mother contests, it gets more expensive and complicated. You may also try a guardianship. Nevada has a six month guardianship without a court order or you can petition the Court for a regular guardianship. I would be happy to help you. My retainer would be $1,000. My telephone number is 474-4220 and I would be happy to give a free telephone consultation.

The child can file for emancipation or you can petition to become guardian of the child. You need a family law attorney.
