Legal Question in Family Law in Nevada

To Whom It May Concern:

I have a question regarding child support payments to my ex-wife. I live in New York and I have been divorced from My ex for 6 years. We have one child who is 17 years old and will be 18 in January of 2006. Six years ago my ex's whole family moved to Las Vegas and she asked me can my son move with them. After talking it over with him, I decided to let him go and not fight her for him to stay here in NY. We never changed the support order in the family court before she left. My question is, I know nothing about Nevada Law. How long do I still have to pay support for him? Does it stop at 18 if he does not go to college? Plus I still pay for his insurance policy. I really don't care how long I have to pay for him, I just would like to know the details. I would appreciate any help in this matter.

Even though your son has lived in Nevada, jurisdiction over child support, custody etc, remains in New York where (I am assuming) you and your ex spouse divorced.

The obligation to pay child support, continues in NY, until the child attains age 21, or is otherwise emancipated.

If the Divorce and child support was issued in NY, NY law is applicable, not the law of Las Vegas.

However, if the insurance you reference is for health care, you may want to investigate what adjustments need to be made, in order for your child to receive coverage and care "out of state." Note, you don't want a situation where huge medical bills accumulate because the policy you have, does not extend to where your child regularly lives.
