community property in Nevada

My wife was assualted at her place of employment by an executive that worked there. This happened during the time we were married. The case is about to settle. Are the proceeds from this settlement community property or is it separate property?

The pain and suffering is separate property. The lost wages and any loss of consortium should be divided between the two of you.

Generally speaking, a personal injury settlement is that spouse's separate property. However, certain elements of damages, such as lost wages, may be considered reimbursement to the community. So, I would need to know more facts to advise you exactly but that should give you an idea. For the most part, personal injury settlements are separate property. See NRS 123.130.
