is an out of court written custody agreement legal?
If I typed up a binding custody agreement stating I had full custody of my daughter but didn't file it in a court of law..would it still be binding? My daughters father wants her to come visit him in Nevada at Christmas,,but I am concerned he will keep her. He sent me a guardianship agreement which he signed and had notarized,,but I am still concerned it may not be enough to get her back if he decideds he wants to keep her.
I would be happy to fax you the agreement he signed for me,..if you could provide me with a fax number.
She is very anxious to go see her father, I just want to be sure that she comes back to me.

custody of a child in a divorce proceeding is a result of an order of the court. are you divorced and if so is there a custody order in your decree and are there visitation provisions in your decree for your x husband. your proposed agreement is not a court order and therefore not enforceable in a court of law. i would also like to know more about the guardianship agreement that your husband has. there are too many missing facts in your question to give you any reliable answer. call me if you wish to discuss further. 205-879-9595
