You have to go to Mississippi unless the child is a victim of domestic violence. If that is the case, you can petition for custody under emergency protection jurisdiction. The child must be visiting Nevada when you file the Petition.
Mr. Cogan is correct.
You can also get the parents to sign over temporary guardianship to you. I do not generally recommend that unless it is an emergency situation.
If one or both parents is about to go to prison, then I highly recommend that you seek adoption over the child so that you will have the rights of a parent which cannot be stripped form you like guardianship can. I have seen too many cases where a grandparents has guardianship for many years, only to lose the child altogether once the parent comes back into the picture.
If the parents are willing to sign over their rights to you, do it now before they change their minds.
