Can my custody order be changed if one party is unwilling?

Yes. You would need to file a Motion for a change in custody and you would have to explain both that there is a significant change in circumstances since the last order as well as that the proposed change in custody is in the child's best interests. The judge will then decide whether what you say is true.

Mr. Wright forgot about the Rivera holding. Basically, if you have your child more than 40% of the time, that constitutes grounds to give someone who has visitation a shared primary custody order.
