Legal Question in Family Law in Nevada

I do not have a custody order, however my childs father has been in and out of jail and prision, in which I care for my daughter full-time. Do I need to file for custody?

No, but you may want to think about terminating his parental rights. If you did not both sign an "Affidavit of Paternity" and were not married and he has never filed a case to establish parental rights, he has not rights, not custody, not visitation. However, if he is in prison, now is the time to terminate his rights if that is what you desire.
