Legal Question in Family Law in Nevada

Divorce was in May 2016, and amended in Oct. 2016 with the date of divorce still as May 2016, to add the QDRO's and some other things, my husband had been employed by MEBA. Merchant Marine's Union & employer for nearly 23 years. The judge awarded me half of his pension and half of retirement. Nevada courts and 7 year marriage. In Oct. for the amendment ex came in with news of his new marriage. Nothing big. I have called and got nowhere or I heard nothing from my lawyer, even though I continued to bug him about protecting my interests. Now, since my ex didn't retire until after our divorce was final & without QDRO's in place and still not in place but the Union has said they were good QDRO's and awaiting signature of Judge but his attorney is holding it up with objections to it and Judge won't sign unless both attorneys agree. Will that be a problem for me collecting my share with the Union?

Quite possibly. This is a specialized area and there are few lawyers (or judges) that really understand how these things work and why. For background, and a pretty comprehensive explanation, see the article titled "Retirement Plan Division: What Every Nevada Divorce Lawyer Needs to Know (CLE, Ely, Mar., 2013)" posted at http://www.willicklawgroup.com/published-works/. You have significant dangers depending on what options were selected by your ex at retirement -- some of which can be addressed by other court orders, and some of which may not be correctable. It is more complicated than I can fully explain by e-mail, but if you call the office and speak with our QDRO staff, we should be able to answer your questions and provide you with alternatives to get to "done" as effectively as possible.
