Re: How to divorce in Canada when married in Nevada

Please note that the postal code given by this inquirer is not a valid postal code. This answer is specifically for British Columbia and does NOT apply outside B.C. To rely on the answer given if the individual concerned lives outside B.C. is not adviseable as the law varies from province to province. In B.C., where you were arried is not material to whether or not you may divorce in British Columbia; provided you or your spouse has been ordinarily resident in B.C. for at least one year immediately before you commence the divorce proceeding. There is no such thing as "registering" a marriage in B.C. A marriage certificate can be obtained when you retain a lawyer for the divorce proceedings. If your divorce does not deal with all issues, the other spouse may come back at any time to deal with child custody & access , child support & spousal support, and after a limited time to deal with division of assets. If all issues are dealt with in the divorce proceedings, then in B.C. your spouse may come back to have changes made to the child custody and access issues and to child and spousal support when there has been a material change in circumstances.
