My wife brought our condo 3 months before we married. She put 3000 down. I pay 300 a month to her and moved in when she did.

The condo is in her name but 3 years ago we got a home equity loan in both our names. We brought the condo for 137,500. With the home equity loan the total is 180,000. I have payed over 40,000 to our common bills during our 4 year marriage, she has spent around 38,000.

Do I have any interest in the condo, she says she wants to keep it even though she is renting it to be for half of the mortgage payment(400 a month). I say she is buying me out by paying half the mortgage.

Yes, you have an interest in the condominium but not based on your dollar per dollar contribution. There is a case in Nevada, called Malmquist, that contains the formula for figuring out what your interest in the condo would be. You should contact an attorney to find out what your interest is in the condominium, and your rights in general.
