divorce - income tax filing

my soon to be ex filed our taxes without my signtaure and took the refund (post filing but before decree was issued), do I have recourse or is there legal action I can take on the fraud?

You would have to take you ex back to divorce court in a post-divorce motion to ask for part of the refund
