Legal Question in Family Law in Nevada

Divorce question

Separated for 10 years. Dad has had physical custody of 11 & 13 boys during that time. Mom has been to prison for drugs. Lives in CA. Has very little contact other than occasional calls. Dad wants divorce and mom agreed to sign. He doesn't want child support, wants sole physical and legal custody. Doesn't want written in stone custody agreement. He would like to do the divorce himself and save $. Would he be able to do that or is it best to get an atty because of the custody and child support issues? Have also thought of having mom relinquish parental rights and avoiding child support and custody. Would this be the better way to go about this?

You need to meet with an attorney. Something like this could come back to haunt you. Mom could change her mind and you could spend tens of thousands of dollars defending work that may have been improperly done.

Courts do not like terminating parental rights and in this case, a court would rather deny her any contact until she has proven herself clean and ready to be in the children's life. The court would require her to petition for visitation and then give her little visitation in the beginning, probably supervised and then if it goes well, more and more, taking maybe 6 months for the first overnight visitation.
